Terms of Service

These Terms of Use (or “Terms”) are between you and Blossom (“BoltOps”, “Blossom”, “us” or “we”) and, together with the Blossom Privacy Policy, govern your use of Blossom. If you have any questions about these Terms or the services offered by Blossom, please contact us at support@boltops.com.

  1. BoltOps offers a range of services through its Blossom platform, including application release, managed infrastructure, and reliability automation. These services are collectively referred to as the BoltOps “Platform”.

  2. Acceptance. To use Blossom, you must agree to be unconditionally bound by these Terms. You accept the Terms by clicking to accept or agree to the Terms where this option is made available to you in any agreement or electronic form, or by visiting or using Blossom in any manner. If you use Blossom on behalf of a company or other entity, you represent, agree, and warrant that you are authorized to act on behalf of the entity and to bind such entity to these Terms.

  3. Registration. While anyone may browse Blossom’s public sites, access to most features requires registration. To become a registered user (“User”), you must create an account with valid login credentials (username and password) and provide accurate and current contact information. You are responsible for maintaining the security of your login credentials and keeping your account information up-to-date.

  4. Communications. By using Blossom, you consent to receiving electronic communications from us regarding your account, service updates, security notifications, and other related products or services. These communications may be sent via email or through other electronic means.

  5. Using Blossom. You can use Blossom to access release tools and server management features, purchase subscriptions, communicate with Blossom and others, and manage your infrastructure. As a User, you may access certain limited aspects of Blossom for free or you can subscribe to enhanced access and use of Blossom for the fee stated when you signup.

  6. Blossom Services. Blossom owns all rights, title, and interest in and to the Services, which includes without limitation the Blossom platform (including without limitation all tools, materials, source code, templates, and other content contained therein) and all images, illustrations, designs, photographs, video clips, text, graphics, icons, designs, software code, written information and screens appearing therein, and other materials, as well as names, logos, taglines, trade dress, and other trademarks therein.

  7. User Application. As a User, you may use BoltOps to build one or more User Applications according to the terms and conditions of your subscription. You own all right, title and interest in and to your User Application(s), including without limitation all images, illustrations, designs, photographs, video clips, text, graphics, icons, designs, software code, written information and screens appearing therein, and other materials, as well as names, logos, taglines, trade dress, and other trademarks therein. BoltOps does not control and is in no way responsible for, and will incur no liability related to, your User Application or any contents, features, functionality, or use thereof. In the event of a security incident unrelated to BoltOps Services or information systems (“Security Incident”), you are responsible for detection, response, and any public statements regarding such incident, with no obligation to report to BoltOps.

  8. License Grant. If you meet the Eligibility requirements, Blossom grants you:

    (i) as a registered User, a limited, revocable, non-transferable, non-sublicensable, non-exclusive, worldwide license to use Blossom solely for your own business operations as permitted by your subscription plan; and

    (ii) a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use all other Blossom Services for your own personal, internal business purposes, subject to the features, usage limits, and restrictions specified in your subscription plan.

    You may not resell, redistribute, or commercialize Blossom or any of its components as your own platform or service offering. This includes, but is not limited to, repackaging Blossom’s features, tools, or infrastructure management capabilities under your own brand or as part of your commercial services.

  9. Servers and Infrastructure Management. Blossom may provision, configure, replace, and delete Product-owned infrastructure required to provide the Services. In BYOC, that infrastructure resides in a Cloud Provider Account you connect to Blossom. You retain ownership of that Account while authorizing Blossom to manage the resources used by the Product.

    You are responsible for Cloud Provider credentials, provider fees, Account-level access, and changes made outside Blossom. Direct modifications to Blossom-managed resources may interrupt the Services or be reverted by reconciliation. Blossom is not responsible for charges, failures, or data loss caused by unauthorized access, revoked credentials, provider action, or changes made outside the Product contract.

    Blossom Cloud customers do not receive administrative access to the underlying host infrastructure. BYOC customers may observe provider resources in their own Account, but Blossom may drain, replace, or upgrade those resources as part of normal service delivery.

  10. Backups and Data Protection. While Blossom provides backup services and tools, you acknowledge and agree that:

    • Blossom cannot guarantee the success, reliability, or completeness of any backups performed through our platform
    • Backup failures may occur due to factors outside of Blossom’s control, including but not limited to:
      • Changes to your server configurations
      • Modifications to network settings
      • Expiration or changes to your cloud provider credentials access keys
      • Server access restrictions or modifications
    • You are solely responsible for:
      • Maintaining your own backup strategy
      • Verifying the success of backups
      • Ensuring proper configuration of backup storage credentials
      • Maintaining server access and permissions required for backups
    • While Blossom strives to provide reliable backup services, you should not rely solely on Blossom’s backup features for your data protection needs
    • You are encouraged to implement additional backup solutions independent of Blossom’s services
  11. Data Security. Your network, operating system, and software of your web servers, databases, and computer systems (collectively “Systems”) must be properly configured to securely use Blossom. You shall not architect or design Systems in a manner to avoid these obligations. If you violate our system or network security, you may face civil or criminal liability. We may investigate any suspected violations and reserve the right to cooperate with law enforcement authorities in typographycuting users who are involved in such violations.

  12. Billing and Payment. If your use of Blossom incurs a fee, you agree to the following:

    • Subscriptions automatically renew for the same term at the end of each billing period unless you cancel or modify your subscription before the renewal date. Any special terms or conditions will be stated at the time of purchase.
    • As Blossom services are digital in nature, all sales are final. We do not provide refunds for any purchases, subscriptions, or fees paid through Blossom.
    • ALL PURCHASES ARE FINAL AND NO REFUNDS WILL BE ISSUED FOR ANY FEES PAID.
  13. Acceptable Use. Any use of Blossom not expressly permitted by these Terms is prohibited. You agree not to:

    • Copy, reverse engineer, or make derivative works
    • Rent, retransmit, disclose, or sell any portion of Blossom
    • Use the platform for fraudulent or illegal activities
    • Share account credentials with unauthorized users

    Blossom may suspend or terminate your access to our Services if we determine, in our sole discretion, that you have violated these Terms, our policies, or any other agreements with us. To be clear, such suspension or termination will not affect access to your User Application - you, your clients, and applications you’ve built using our platform.

  14. Term and Termination. These Terms become effective upon your first use of Blossom and remain in effect until terminated. You may terminate at any time by canceling your subscription. Blossom reserves the right to terminate or suspend your access to the Services: for violations of these Terms, for non-payment of fees, if your use poses a security risk, or for any reason at our discretion, with or without prior notice.

  15. Amendment. We may amend these Terms from time to time by updating this page. The then-current version shall apply each time you access or use Blossom.
